NEW YORK — Manhattan prosecutors are seeking a new indictment against the disgraced film producer Harvey Weinstein to shore up their case ahead of his trial next month, court records show.
Manhattan District Attorney Cyrus Vance Jr.’s office planned to present another alleged victim of Weinstein’s to a grand jury to support predatory sexual assault charges against him, according to court filings.
The accuser is Annabella Sciorra, the actress known for her role in “The Sopranos” who says Weinstein violently raped her in 1993, according to Page Six, which first reported the legal developments Thursday.
Prosecutors directed Weinstein to appear before the grand jury Friday if he wanted to testify, court records show. The grand jury must vote on a new indictment before its term ends Aug. 26, just two weeks before the scheduled start of Weinstein’s trial on Sept. 9, the filings indicate.
Manhattan prosecutors have charged Weinstein with five crimes including two counts of predatory sexual assault, which comes with a maximum sentence of life in prison. To convict Weinstein, prosecutors must prove he commited one of four serious sex crimes against at least two people.
Prosecutors already have two alleged victims to support the charges: A woman whom Weinstein is accused of raping in 2013 and another whom he’s accused of forcibly giving oral sex in 2006. Prosecutors want Sciorra to testify against Weinstein as a third victim, but a judge ruled last week that her claims could not be added to the charge because the grand jury that indicted Weinstein had not heard from her.
“(W)e do believe that the trial jury should have the benefit of hearing the testimony of the remaining witness and therefore, we will cure the deficiency by representing the case to a new Grand Jury,” Assistant District Attorney Joan Illuzzi-Orbon, the lead prosecutor in the case, wrote in a Tuesday court filing.
Weinstein’s lawyers reportedly argue his trial could be delayed more than a month, as they should have 45 days to file motions after a new indictment comes in.
